Only tree branches, tree limbs and other shrubbery shall be placed on the City burn pile.  No lumber, building materials, tires, paper waste, building demolition products, or any other item shall be placed on the City burn pile.

The roll off waste container shall be for the collection of household trash and garbage.  All items must be placed inside the roll off container and there shall be no dumping or placing of items on the outside of the roll off container.  If the container is full, no more trash shall be placed in the container.  The roll off container shall not be used to dispose of automobiles and automobile parts, large appliances, hazardous materials, solvents, paint, oils, cleaning products, controlled substances, liquid petroleum products, radioactive waste, medical waste, asbestos, industrial chemicals, tires, batteries, PCB’s, or dead animals.

Any person violating any section of this article may be prosecuted in Municipal Court of the City of Mount Hope, Kansas. Upon conviction, there shall be a fine of not less than $100.00 for the first offense and a fine of not less than $300.00 for a second and subsequent offenses.

In addition to the penalty set out above, the offending party may be ordered to remove the items illegally disposed of and/or pay the cost of such clean up.  It is not necessary for the offending party to be convicted prior to the Court ordering site be cleaned up.
