A CHARTER ORDINANCE EXEMPTING THE CITY OF MOUNT HOPE FROM THE PROVISIONS OF KANSAS STATUTES ANNOTATED (KSA)12-1222 RELATIVE TO THE REQUIRED NUMBER OF PUBLIC LIBRARY BOARD MEMBERS AND PROVIDING A SUBSTITUTE PROVISION ON THE SUBJECT OF REQUIRED NUMBER OF PUBLIC LIBRARY BOARD MEMBERS.

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF MOUNT HOPE, KANSAS:

SECTION 1. The City of Mount Hope, Kansas, by the power vested in it by Article 12, Section 5 of the Constitution of the State of Kansas, elected to exempt itself from and make inapplicable to it the provisions of K.S.A. 12-2222 relative to the required number of board members of the public library board, being an enactment applicable to such city, but not applicable uniformly to all cities, and further provide for a substitute provision on the subject of the required number of board members of the public library board.

SECTION 2. The number of members appointed to the public library board shall be five. The terms for all members appointed shall be for four (4) years. However, two of the members of the first board appointed shall serve a term expiring the second April 30 following date of appointment, two shall serve a term expiring the third April 30 following the date of appointment and one shall serve a term expiring the fourth April 30 following the date of appointment.

SECTION 3. In addition to the appointed members of the board, the Mayor of the City of Mount Hope Kansas, as head of the municipality, shall be ex officio a member of the library board with the same powers as appointed members, but no person holding any office in the municipality shall be appointed a member while holding such office.
