A CHARTER ORDINANCE EXEMPTING THE CITY OF MOUNT HOPE FROM CERTAIN PROVISIONS OF K.S.A. 12-4112; PROVIDING SUBSTITUTE AND ADDITIONAL PROVISIONS WHICH RELATE TO THE ASSESSMENT OF COURT COSTS IN THE MUNICIPAL COURT OF MOUNT HOPE, KANSAS, AND REPEALING ORDINANCE NO. 91-8-6, SEC. 1.

Section 1.  The City of Mount Hope, Kansas, by the power vested in it by Article 12, Section 5 of the constitution of the State of Kansas, hereby elects to exempt itself from and make in applicable to it that part of K.S.A. 12-4112, and amendments thereto, pertaining to the assessment of court costs in the municipal court of Mount Hope, Kansas, by substituting the following:

Court Costs.  In all cases in which a person is charged in the municipal court of the city with the violation of any ordinance of the city and such person is adjudged guilty of any violation or enters a plea of guilty or no contest to such violation, such person shall be assessed court costs in the amount of $34 in addition to any other fine or penalty assessed to such person.  No person shall be assessed costs for the administration of justice in any municipal court case, except for witness fees and mileage as set forth in K.S.A. 12-4411, and amendments thereto; and, in every municipal court case, court costs of $27 and $7 for the assessment for the judicial branch education fund as set forth in K.S.A. 20-1a11, (1994 Supp.) and amendments thereto; and for the assessments required by K.S.A. 12-4117, and amendments thereto; and for the law enforcement training center fund established pursuant to K.S.A. 74-5619, and amendments thereto; and the local law enforcement training reimbursement  fund established pursuant to K.S.A. 74-5620, and amendments thereto.
